Terms & Conditions for Monthly Registrations for :

KINDLY READ BEFORE YOU REGISTER

(*Baby Classes, Kids groups and private Classes, Adults Groups and private Classes, Ladies only Group Classes*)

Monthly Registrations:

– All customers booking a service with The Fit Sport Clubs Management L.L.C must fill out an online registration form or a physical form provided by our ADMIN.
– The participant, or the participant’s Parent/Legal Guardian (if the participant is under 18), must agree to the terms and conditions, code of conduct, and payment policy of The Fit Sport Clubs Management L.L.C as outlined below.

### Overview:

The Fit Sport Clubs Management L.L.C offers services related to sport activities, including but not limited to swimming and fitness sessions.

– Participants are allowed to attend a free one-time assessment before their first class; however, this is not mandatory.

If you book the participant in a class without a prior assessment, The Fit Sport Clubs Management L.L.C reserves the right to shift the participant to a more appropriate class for learning and safety standards.

– The Fit Sport Clubs Management L.L.C also reserves the right to shift a participant to a different level during the term or holiday time to ensure proper progression.

– Class timings or coaches of a scheduled class/activity may need to be adjusted for various reasons:
– Change session timings, with prior notice given to all participants.
– Cancel a class in cases of emergency due to coach sickness if no substitute can be found in a timely manner.
– Change the coach of a session with another coach from The Fit Sport Clubs Management L.L.C.
– Change the session area or cancel a session if the appropriate teaching area is not available on that day.

### Health and Safety:

#### Baby Classes Terms & Conditions:

– We accept babies and toddlers aged 6 months and above.
– Class duration is 20-30 minutes.
– One of the parents must be in the water with the baby for their safety and must take responsibility for safety along with the instructor.

#### General Health and Safety:

– You understand and acknowledge that taking part in sport activities and exercise involves a degree of risk, including but not limited to abnormal blood pressure, fainting, heart disorders, heart attack, stroke, or even death. There is also the possibility of injuries, including but not limited to damage to muscles, bones, organs, tendons, and joints.
– You will inform The Fit Sport Clubs Management L.L.C Admin staff regarding any medical issues or conditions that a participant may have, including but not limited to diabetes, medication, allergies, disabilities, etc., so that our coaches and staff can be informed in case of an emergency.

– You acknowledge that the participant is medically fit and allowed to take part in the activities offered by The Fit Sport Clubs Management L.L.C. It is your responsibility to inform us of any changes in the participant’s health and wellbeing.

– You explicitly agree to assume all risk of death or injury to you/your child and/or loss of or damage to any property of The Fit Sport Clubs Management L.L.C or any parent, subsidiary, or affiliate company resulting directly or indirectly from their participation. You expressly release and discharge The Fit Sport Clubs Management L.L.C and its owners, employees, agents, hired venues, and assigns from any and all liabilities, claims, suits, demands, or actions arising from or in connection with the participation in the sports activities programs. This release shall be binding on my heirs and executors and those of my son/daughter.

– You further agree that should you/your child behave in any manner deemed by The Fit Sport Clubs Management L.L.C as disruptive or that could lead to injury of the participant or any other participant, The Fit Sport Clubs Management L.L.C is hereby authorized to expel the participant from any further participation in the sports activity programs without a refund.

– Management or their hired venues will not be liable or responsible for any personal injury, accident, or death, or any loss or damage to personal property or vehicles caused to or suffered by any visitors, participants, spectators, or invitees attending any of the activities hosted by The Fit Sport Clubs Management L.L.C at any of their venues. All participants, spectators, or invitees will be responsible for obtaining appropriate insurance in relation to the conducted activities.

### Agreement for Media of All Participants:

By agreeing to the activities of The Fit Sport Clubs Management L.L.C, you consent to having photos/videos/pictures/images/recordings made of the participant, which can be used to promote The Fit Sport Clubs Management L.L.C both internally and externally. These images could be used, but are not limited to, print, digital publications, social media marketing, teaching, and training purposes. You understand that images of the participant may be used on The Fit Sport Clubs Management L.L.C platforms.

### Payment Through Network and Pay by Link, Emails, and Website:

By proceeding with the payment and using the services provided by The Fit Sport Clubs Management L.L.C, you acknowledge and agree to the following terms and conditions:

1. **Fixed Prices: **
– Payment through the website is at fixed prices and is non-negotiable.

2. **Booking and Registrations: **
– Booking and registrations begin on the same day as the payment.

3. **Single Classes: **
– Single class payment is valid for a single entry only and cannot be used more than once by one person.

4. **Proof of Payment: **
– Presentation of the receipt and payment confirmation email is mandatory to commence classes.

5. **Package Expiry: **
– Packages are valid for 30 days only. No extensions or additional classes beyond the specified limit.

Absence: Missing a session without at least one day’s notice is considered an absence. However, if you or your child misses a class due to a medical reason and provides a medical report one day in advance, we can offer a make-up class within the same week, provided there is an available slot at the same group class level.

### Refund Policy:

**No Refunds After Classes Begin: **

No Refunds: Once Trial class is done, started the package, payment is completed, NO refunds will be issued.Payments made through the website/online / Payment Machine / Cash are at fixed prices and non-negotiable.
Refunds are only processed in special cases, such as traveling or moving out of the city, and are subject to the company’s discretion. If the provided proof is deemed invalid, the company reserves the right to deny the refund.
Approved refunds may take 30 to 45 days to process. Additionally, a 15% deduction from the total amount will be applied to cover payment gateway and network fees, as these services charge a commission on every transaction.

**Schedule Changes and Coach Substitutions: **
– Occasionally, schedules may need to be changed, and coaches may need to be substituted. These changes do not entitle you to a refund.

### Single Use:

– Every monthly package or single class can be utilized once by one person only.
